Depending on the country/state in which it happened, the punishment may vary. Ava is from Canada, and SR was based there at the time, unless she lived in LA as well.
Like many SA cases, proving that someone was assaulted can be tricky, as there's no way to truly know unless there was a video of some sort.
In Canada, a victim's statement alone can be enough if the judge finds it credible and reliable during a testimony.
Hard evidence-wise, there needs to be evidence (screenshots) of the following:
- Brick saying "no" or showing reluctance
- Ava pressuring or guilt-tripping Brick
- Apology or acknowledgment from Ava
- Phone log showing Brick calling her mom, trying to leave
- Photos showing injury, distress, or Ava's location
- Medical records (ER visit, bruises, bleeding, STI, etc.)
- Forensic evidence (SA evidence ki,t but needs to be shortly after it happened)
- Blood on clothes or bedding
In Canada, guilt must be proven beyond a reasonable doubt. The defense (Ava) doesn't have to necessarily prove that she's innocent; she just needs to raise reasonable doubt.
If Ava is found to be innocent, she can sue Karie (poster) and Brick for defamation.
